The Bulldog Announces the Move to Go Smoke-Free in Louisiana


On January 1, 2007, all Louisiana workplaces and restaurants became 100% smokefree. The statewide smokefree law also fully restored local control, to give local governments the ability to expand smokefree protections in their communities for areas not covered by the state law, such as bars. This is a major victory and step forward for public health in Louisiana.

Less than two hours later, her group held a press conference at the Main Library on Goodwood to announce some high-profile support for its effort, most notably that of AARP. The campaign is officially on to rid Baton Rouge bars and casinos of smoke, and organizers are launching a full-court press. Though the Louisiana Legislature banned smoking in all public buildings and restaurants several years ago, bars and gambling facilities were exempt. Now, a coalition of health groups has formed Smoke-free East Baton Rouge to extend the ban to all establishments in the parish. The exemption makes for bad public policy, says Kuykendal, a lobbyist for the American Cancer Society Action Network. Metro Councilman John Delgado, also a bar owner, agrees theres no economic argument to be made for allowing smoking in bars. Quite the contrary, he says. Three of his four establishments prohibit smoking, and it hasnt hurt business.

Harrahs Casino in New Orleans vehemently opposed the ban and has blamed it on a decrease in revenues. But Kuykendal says its impossible to know whether the smoking ban was actually the cause of Harrahs $12 million revenue decline during the second half of 2015.

Most businesses are in complete compliance. Last spring and summer, her department provided ban-related resources to local businesses and workers. But Harrahs is far from satisfied, pointing to lost revenue since April while earnings at nearby Jefferson Parish casinoswhere smoking is allowedhave risen. Harrahs wants permission to reduce its local staff from a state-mandated level set over a decade ago. To boost earnings and accommodate smokers, Harrahs this summer asked the New Orleans City Council and the citys planning commission if it could build outdoor courtyards with slot machines.

The level of fine particle air pollution fell by 96 percent in venues that had previously allowed smoking, and it was virtually eliminated in the casino, where there was a 99 percent reduction. The study was conducted by nationally recognized indoor air quality researchers at the Roswell Park Cancer Institute in Buffalo, NY. It used state-of-the-art air pollution monitors to measure the levels of fine particle air pollution in 13 bars and the one casino both before and after the smoke-free law took effect. According to the study, particles of this size (smaller than 2.5 microns in diameter) are released in significant amounts from burning cigarettes and are easily inhaled deep into the lungs, causing a variety of adverse health effects, including cardiovascular and respiratory disease and death. ...

The amendment defines a cigar bar as a bar that generates at least 35 percent of its income from the sale of cigars and related products, excluding cigarettes; it permits such establishments to operate in the French Quarter despite an existing ban on new cocktail lounges there. Critics said the change will mean a proliferation of cocktail lounges, disguised as cigar bars, in the Quarter. Mayor Mitch Landrieus administration opposed the amendment, saying that the Habana Hemingway bars fate should have been decided by the Planning Commission as a conditional-use issue, not a zoning matter. However, the amendment passed 6-1, with Councilwoman Susan Guidry opposed.

According to the group Americans for Nonsmokers' Rights, which maintains a database of statewide and local smoking laws, 13 states have pre-emption laws that prevent local governments from following New Orleans's example and imposing restrictions greater than the state's. Seven of these states have fairly robust smoking bans, but four have much looser statewide restrictions while limiting local attempts to institute new bans. The other two states have narrow pre-emptions, restricting only a few categories of municipal law. Of these two states, one has a wide-ranging statewide ban, and the other allows smoking in more places.

Their aim is to make every city, parish and business smoke-free. Shreveport business owner Christopher Anthony moved from California where smoking in bars is also banned. But he feels differently from the Canadian couple about the idea, "You don't want to go home smelling like second hand smoke, so it is a good idea," said Anthony. He loves the idea so much, when he opened up this Downtown Shreveport bar, he chose to pay extra money for a restaurant license instead of a bar license to make sure his business would be smoke-free. "That way I can have families come in and not have to worry about smoking," Anthony explained. But Anthony says his smoke-free bar continues to attract both smokers and non-smokers. "Oh yeah I still get a packed house every night," he said.

David Heitmeier, D-Algiers, which the Senate Committee on Health and Welfare passed unanimously on Wednesday, awaits final action by the full Senate. If the Legislature passes Heitmeier's bill and Gov. Bobby Jindal signs it, Louisiana will join Arkansas, Oklahoma and the Northern Mariana Islands, which have outlawed smoking on publicly run colleges, according to American Nonsmokers' Rights Foundation, a lobbying organization. Iowa has gone one step further, forbidding people to light up on all of the state's 66 campuses, public and private, according to the organization's website. Legislators in Illinois, Maine, New Jersey, North Carolina and New Mexico are considering bills similar to Heitmeier's, said Bronson Frick, a foundation spokesman. In addition to these statewide bans on college smoking, about 1,150 campuses have forbidden smoking, according to the foundation, which updates such information quarterly. This trend toward smoke-free campuses is about 10 years old, Frick said. Restaurants have done it, schools did it years ago, government buildings followed suit, and hospitals came soon after.

The latest on the list of places to prohibit smoking is Rouquette Lodge, the Christopher Homes-operated apartments for elderly on the Northshore, sent a letter to its residents Oct. 25 announcing that as of Jan. 1, 2011, the facility, which is located in Mandeville, will be non-smoking environment.

“This means that there will be no use of any lit tobacco product in these buildings or anywhere inside the buildings; which includes apartments, common areas, balconies, porches, entryways an openings to the buildings,” the letter reads.

Currently smoking is prohibited in the common areas of the buildings and in the large dining hall. However, it is allowed in the apartments and on balconies as well as in the outdoor areas.

After Jan. 1, 2011, the only places where residents will be allowed to smoke, will be in select designated outside areas, which Dennis Adams, executive director of Christopher Homes, said, will likely include some of the facility’s gazebos. ...

About 15 patrons, outfitted with a personal air quality monitor often concealed in a purse, casually ordered at restaurants and bars across Louisiana. While the customers ate and socialized, the devices discreetly sucked air through a pump and past a laser, which measured the mass concentration of particles in the air.

They stayed at least 30 minutes before leaving the establishments, where servers and bartenders never discovered the patrons were collecting data for a researcher studying the impacts of laws restricting smoking in restaurants.

"Before the ban went into effect, you did have a substantial portion of restaurants in the unhealthy to hazardous [air quality ranking], but after the law went into effect, not a single restaurant in this study was considered hazardous," said Daniel Harrington, a researcher who studied the effects of Louisiana's tobacco regulations. "We wanted to measure restaurants and bars across the state, but we weren't trying to call out individual establishments."

Harrington, an Environmental and Occupational Health Sciences assistant professor in the School of Public Health at the LSU Health Sciences Center in New Orleans, spoke Friday during the School of the Coast and Environment's weekly seminar series.

Harrington's research, "Louisiana Hospitality Workers' Exposure to Secondhand Tobacco Smoke: Impact of the Louisiana Smoke-Free Air Act," found "substantial change" and "big improvements" in air quality at restaurants after the law went into effect in 2007, and Harrington said these findings should further efforts to extend smoking bans in Louisiana to stand-alone bars and casinos. ...

BATON ROUGE, La. -- LSU residence halls have been smoke free since 1998, and now there's a new ban.

Students caught with a water pipe, known as a hookah, will have it confiscated by campus officials. But people who use hookahs may have other problems.

It's a popular way for people, especially young adults, to gather and socialize, smoking together using a water pipe called a hookah. But this semester LSU students in Baton Rouge have been told there are new rules: no hookahs allowed in or outside university residence halls.

"We decided to opt to list it specifically as potential drug paraphernalia and to outlaw it in line with our current policies of smoke free and illegal drug free," said Steve Waller, the director of the Department of Residential Life at LSU.

LSU officials are worried that it is a fire hazard, that it is unhealthy and students could also use the pipe for marijuana. ...

The Senate Health & Welfare Committee, you might recall, voted unanimously last week to approve legislation by Sen. Rob Marionneaux, D-Livonia, that would expand the smoking ban to cover casinos and bars. But that was hardly unexpected, as the full Senate passed a similar bill last year.

The real test will come in the House, where Marionneaux's bill died a year ago and where members are traditionally more receptive to arguments from the business community that a ban will hurt their bottom line.

While Marionneaux's bill still awaits action by the full Senate, Rep. Rick Nowlin, R-Natchitoches, has a bill scheduled in the House Health & Welfare Committee that would ban smoking in riverboat casinos, racinos and Harrah's New Orleans Casino unless they provide their patrons with non-smoking areas that have separate ventilation systems.

The bill is a much milder version of what Marionneaux is proposing, but it nonetheless will face strong opposition from the casino industry, which plans to argue that retrofitting the riverboats with separate ventilation systems would present steep engineering hurdles and possibly require them to build new boats altogether. ...

The New Orleans City Council recently passed an ordinance that will restrict new businesses from selling tobacco products if the business is located within 1,000 feet of a school, church, public park or recreation facility.

Smokers, step outside. That's the gist of a bill on the schedule for debate in the Louisiana house Tuesday afternoon. It would ban smoking in bars and casinos, to complement the state's current prohibition on smoking in restaurants, public places, public buildings and most places of employment.
