Louisiana

On January 1, 2007, all Louisiana workplaces and restaurants became 100% smokefree. The statewide smokefree law also fully restored local control, to give local governments the ability to expand smokefree protections in their communities for areas not covered by the state law, such as bars. This is a major victory and step forward for public health in Louisiana.

Sylvester reiterated the desire to create a healthy campus, regardless of what legislation compels the University to do. Some legislation failed for lack of action on the final day of the session. One such bill was HB111 by Rep. Frank Hoffmann, R-Monroe, which sought to ban smoking within 25 feet of the entrance to a state office building. Both the House and Senate approved the measure but an amendment attached in the Senate including marijuana smoking in the 25 feet led to its death. Hoffmann said that since smoking marijuana is illegal, it was ridiculous to have that in state law banning smoking near state buildings. So he got the House to reject the amendment and send the bill to a conference committee to take it out.

Bobby Jindal signs it, Louisiana will join Arkansas, Oklahoma and the Northern Mariana Islands, which have outlawed smoking on publicly run colleges, according to American Nonsmokers' Rights Foundation, a lobbying organization. Iowa has gone one step further, forbidding people to light up on all of the state's 66 campuses, public and private, according to the organization's website. Legislators in Illinois, Maine, New Jersey, North Carolina and New Mexico are considering bills similar to Heitmeier's, said Bronson Frick, a foundation spokesman. In addition to these statewide bans on college smoking, about 1,150 campuses have forbidden smoking, according to the foundation, which updates such information quarterly. The latest on the list of places to prohibit smoking is Rouquette Lodge, the Christopher Homes-operated apartments for elderly on the Northshore, sent a letter to its residents Oct. 25 announcing that as of Jan. 1, 2011, the facility, which is located in Mandeville, will be non-smoking environment.

“This means that there will be no use of any lit tobacco product in these buildings or anywhere inside the buildings; which includes apartments, common areas, balconies, porches, entryways an openings to the buildings,” the letter reads.

Currently smoking is prohibited in the common areas of the buildings and in the large dining hall. However, it is allowed in the apartments and on balconies as well as in the outdoor areas.

After Jan. 1, 2011, the only places where residents will be allowed to smoke, will be in select designated outside areas, which Dennis Adams, executive director of Christopher Homes, said, will likely include some of the facility’s gazebos. ...

About 15 patrons, outfitted with a personal air quality monitor often concealed in a purse, casually ordered at restaurants and bars across Louisiana. While the customers ate and socialized, the devices discreetly sucked air through a pump and past a laser, which measured the mass concentration of particles in the air.

They stayed at least 30 minutes before leaving the establishments, where servers and bartenders never discovered the patrons were collecting data for a researcher studying the impacts of laws restricting smoking in restaurants.

"Before the ban went into effect, you did have a substantial portion of restaurants in the unhealthy to hazardous [air quality ranking], but after the law went into effect, not a single restaurant in this study was considered hazardous," said Daniel Harrington, a researcher who studied the effects of Louisiana's tobacco regulations. "We wanted to measure restaurants and bars across the state, but we weren't trying to call out individual establishments."

Harrington, an Environmental and Occupational Health Sciences assistant professor in the School of Public Health at the LSU Health Sciences Center in New Orleans, spoke Friday during the School of the Coast and Environment's weekly seminar series.

Harrington's research, "Louisiana Hospitality Workers' Exposure to Secondhand Tobacco Smoke: Impact of the Louisiana Smoke-Free Air Act," found "substantial change" and "big improvements" in air quality at restaurants after the law went into effect in 2007, and Harrington said these findings should further efforts to extend smoking bans in Louisiana to stand-alone bars and casinos. ...

The Senate Health & Welfare Committee, you might recall, voted unanimously last week to approve legislation by Sen. Rob Marionneaux, D-Livonia, that would expand the smoking ban to cover casinos and bars. But that was hardly unexpected, as the full Senate passed a similar bill last year.

The real test will come in the House, where Marionneaux's bill died a year ago and where members are traditionally more receptive to arguments from the business community that a ban will hurt their bottom line.

While Marionneaux's bill still awaits action by the full Senate, Rep. Rick Nowlin, R-Natchitoches, has a bill scheduled in the House Health & Welfare Committee that would ban smoking in riverboat casinos, racinos and Harrah's New Orleans Casino unless they provide their patrons with non-smoking areas that have separate ventilation systems.

The bill is a much milder version of what Marionneaux is proposing, but it nonetheless will face strong opposition from the casino industry, which plans to argue that retrofitting the riverboats with separate ventilation systems would present steep engineering hurdles and possibly require them to build new boats altogether. ...

Smokers, step outside. That's the gist of a bill on the schedule for debate in the Louisiana house Tuesday afternoon. It would ban smoking in bars and casinos, to complement the state's current prohibition on smoking in restaurants, public places, public buildings and most places of employment.

The Senate passed a similar bill last week. Political analyst John Maginnis of LApolitics.dot.com says both bills have flown largely under the radar. Not anymore.

"The riverboat (casino) association is saying this could cost the state millions of dollars in lost revenues," said Maginnis. He says the casino lobby is arguing "smoking gamblers just might go to Mississippi." ...

Smoking in bars and casinos would be prohibited under legislation endorsed Thursday by the Senate.

The Senate voted 22-10 for the proposed law after senators rejected separate amendments seeking to remove bars and casinos from the ban.

When the state adopted the Louisiana Smoke Free Air Act in 2006, smoking was banned in restaurants but allowed in bars and casinos.

“This bill puts everyone on equal footing … restaurants, bars and casinos,” said Sen. Rob Marionneaux, D-Grosse Tete, sponsor of Senate Bill 186. “It’s the right thing to do so one business is not put at a disadvantage over another.” ...

Gov. Bobby Jindal said he doesn't support a proposal that would ban smoking in Louisiana bars and gambling facilities. But he also said Tuesday that he won't veto the measure if it reaches his desk.
"Personally, I think adults can make decisions for themselves," Jindal said at a wide-ranging briefing with reporters, when asked about the smoking ban bill.

He said many bills proposed this session, like the smoking ban, seem like "nanny state" measures. However, he added of the smoking ban, "I don't feel strongly enough that I would veto that bill."

Legislation that would ban smoking in bars and casinos narrowly passed through a House committee Tuesday.

Members of the House Health and Welfare Committee rejected amendments to exclude cigar and hookah bars from the ban before voting 8-7 to move House Bill 844 to the House floor.

Shreveport adopts ban on smoking in public places

SHREVEPORT, La. After wading through eight amendments and 16 votes, the Shreveport City Council has passed a ban on smoking in public buildings and restaurants that don't serve alcohol.

The ban takes effect in ten days and Mayor Keith Hightower says he has no plans to veto it.
