If someone wants to smoke cigarettes, it is their choice, but it is
important to remember that allowing students to smoke on a college campus
exposes their peers to secondhand smoke. At FGCU, it is nearly impossible
to pass by the smoking area without getting a face full of smoke. The
smell of the smoke clings to your clothes, your hair and your lungs
even after you have walked by.

regulation of smoking to the state, meaning that no local towns, municipalities
or counties can pass anything stricter than the smoking laws passed

International Speedway prohibited smoking in the grandstands, a milestone
for a sport that once was closely tied to R.J. Reynolds Tobacco Co.
Embry-Riddle Aeronautical University, Daytona State College and Stetson
University have snuffed out tobacco on campus. Public health officials
would like to extend those bans even further by prohibiting smoking
on beaches and in parks. They point to mounds of cigarette butts littering
the beaches and the dangers of secondhand smoke as reasons why lighting
up shouldn't be allowed on Volusia and Flagler's shoreline. But even
if the political will existed locally to enact such a ban, cities and
counties are prohibited from restricting smoking outdoors. Only the
state can make those changes. Counties and cities can post signs asking
the public not to smoke, but state law leaves local officials powerless
to enforce the rules.

in Florida just 10 years ago. Needless to say, our state has come a
long way since July 2003, when Florida's indoor workplaces went smoke-free,
with few exceptions. This month, we're celebrating 10 years of cleaner
air and healthier residents thanks to the more than 71 percent of Florida
citizens who voted for this constitutional amendment to Florida's Clean

important event at the Palm Beach County Legislative Delegation Hearing.
Outside of the venue, a young female volunteer that presented on the
dangers of second-hand smoke was surrounded and harassed by 11 representatives
of Cigar Rights of America, a lobbying group. Why is this so important?
This mob mentality is exactly why the tobacco industry was found guilty
in 2006 in a federal court of violating the Racketeer Influenced and
Corrupt Organizations (RICO) Act. Let's be clear: The tobacco industry
was found guilty of a coordinated campaign to lie to the public, using
misinformation tactics to hide the dangerous effects of their products.
In the near future, Big Tobacco will be forced to take out advertisements
admitting to those lies and deceit. Yet the misinformation continues.

and parks, they are most likely unenforceable because of the 2003 act,
says Americans for Nonsmoker's Rights, a national advocacy group that
has been warning local governments for years about Florida's loophole.
The implications are that the poor localities don't have local
authority to pass smoking laws that their communities want, said
Cynthia Hallett, the group's executive director. The only option is
for Florida residents to press the Legislature to change the law and
give local governments authority to pass public smoking bans, as Louisiana,
Illinois, Delaware and other states have done in recent years, Hallett
said. The bad news is you have this case law now, Hallett
said. But the good news is that it gives cities more impetus to
lobby the Legislature to restore local control.

Lawsuits are being filed around the nation, and some attorneys who
represent Florida condominium associations say the issue could soon
be coming to a court here.
Coral Gables real estate agent Ana Anderson moved out of her Silver
Palms condo last month because her neighbors' smoke was seeping into
her walls and through her ventilation system. Minimally, Anderson wants
to recoup the cost of medical bills, sealing off her apartment from
smoke, and wages lost due to illness. She also wants Silver Palms to
become a smoke-free building. She said she will sue if she has to and
is in the process of hiring attorneys who are well-versed in the issues.
Anderson now lives in the in-law quarters of a house she owns. It is
smoke-free and she has control over the environment.
Anderson became physically ill several days after her November move
into her new condo. She muscled through her allergic reactions before
asking the condo association for help to seal off smoke wafting in from
two neighbors' apartments, one next door and one beneath her unit.
Her neighbors at the Dadeland-area complex were sympathetic, and tried
to remedy the situation but could not, she said.
They washed down their walls with bleach, but fresh second-hand smoke
kept pouring in, according to Anderson. Had her neighbors stopped smoking,
the air would have cleared up in a very short while, she said.
"I understand that people have a right to do what they want [in
their own homes] but here's the problem: I spent over $2,000 sealing
my apartment from smoke," Anderson said. ...

found that from 2004 to 2009, the number of states with provisions preempting

and private worksites, and restaurants - decreased from 19 to 12.
Meanwhile, the number of states with preemptive provisions in their
smoke-free laws for all settings decreased from 15 to 8.
"The tide is turning toward allowing smoke-free legislation at
the local level," said Nikole Souder-Schale, southeastern regional
vice president for advocacy for the American Heart Association. "You
have more local elected officials who are interested in having stronger

and sororities when it takes effect next year, under a proposal released
Wednesday by the university.
UF banned tobacco use in Ben Hill Griffin Stadium starting this season
and on the property of health-related facilities starting Nov. 1. A
university-wide ban is planned for July 1.
The proposed regulation, which is scheduled to be considered next month
