Floridians, demand real local control for smokefree air!

Florida's enclosed workplaces, including restaurants and public places, are 100% smokefree as of July 1, 2003 as a result of a state constitutional amendment. Bars are exempt from the smokefree requirements. Florida law still preempts local governments from enacting smokefree regulations, stating, "This legislation expressly preempts regulation of smoking to the state and supersedes any municipal or county ordinance on the subject."

Only the Florida Legislature has authority to regulate smoking, the judge said. The only option is for Florida residents to press the Legislature to change the law and give local governments authority to pass public smoking bans, as Louisiana, Illinois, Delaware and other states have done in recent years, Hallett said. “The bad news is you have this case law now,” Hallett said. “But the good news is that it gives cities more impetus to lobby the Legislature to restore local control.” …

This regulation is a clause in the Florida Clean Indoor Air Act (FCIAA) that mandates how every local community in Florida must handle outdoor smoking. As written, the FCIAA “expressly pre-empts regulation of smoking to the state and supersedes any municipal or county ordinance on the subject.” This means smoking is allowed in every outdoor location in the state, including parks, playgrounds and beaches. Why is this important? Because the current FCIAA does not allow communities to make common-sense decisions about smoking based on local needs. ...

NAPLES — A discussion about whether to ban smoking on Naples beaches could be heading to the state Legislature.

Naples officials said Wednesday they plan to ask the county’s legislative delegation to work with them to change a state law that says who can regulate smoking.

The law — dubbed the Florida Clean Indoor Air Act — has a section that “preempts regulation of smoking to the state and supersedes any municipal or county ordinance on the subject.”

That preemption is believed to apply to all smoking laws, said City Attorney Bob Pritt, and it would make it easy to toss out a local law if it was contested in court.

There are at least a dozen local governments in Florida that have banned smoking, Pritt said.

Naples Mayor Bill Barnett said he wanted to request the help of the county’s legislative delegation, rather than going forward with a discussion about whether it was feasible to ban smoking on city beaches.

“This is the real deal,” he said. “We want to change the statute, or at least have the Legislature tweak it. We want home rule. We want to make our own decisions." ...

That contention has churned up debate among condominium owners over the right to smoke cigarettes in one's own unit versus a neighbor's right to breathe clean air.

Lawsuits are being filed around the nation, and some attorneys who represent Florida condominium associations say the issue could soon be coming to a court here.

Coral Gables real estate agent Ana Anderson moved out of her Silver Palms condo last month because her neighbors' smoke was seeping into her walls and through her ventilation system. Minimally, Anderson wants to recoup the cost of medical bills, sealing off her apartment from smoke, and wages lost due to illness. She also wants Silver Palms to become a smoke-free building. She said she will sue if she has to and is in the process of hiring attorneys who are well-versed in the issues.

Anderson now lives in the in-law quarters of a house she owns. It is smoke-free and she has control over the environment.

Anderson became physically ill several days after her November move into her new condo. She muscled through her allergic reactions before asking the condo association for help to seal off smoke wafting in from two neighbors' apartments, one next door and one beneath her unit.

Her neighbors at the Dadeland-area complex were sympathetic, and tried to remedy the situation but could not, she said.

They washed down their walls with bleach, but fresh second-hand smoke kept pouring in, according to Anderson. Had her neighbors stopped smoking, the air would have cleared up in a very short while, she said.

"I understand that people have a right to do what they want [in their own homes] but here's the problem: I spent over $2,000 sealing my apartment from smoke," Anderson said. ...

That's why lawmakers could move to slap a $100 fine on drivers caught puffing with a kid under 16 years old in the car.

Smoking is already banned in schools and on playgrounds. Logic follows the family car ought to be off limits too.
But tell that to critics, who complain the bill is tantamount to throwing a wet blanket over the flickering flame of freedom.

Now, a new study by Centers for Disease Control and Prevention shows that a growing number of states are allowing local communities to pass smoke-free laws that are stricter than state law. If that trend continues, Florida may soon join other states where smoking is outlawed in all public places and businesses - including bars.

Currently, Florida is among 12 states that still have laws in place that block communities from passing more stringent smoke-free laws than state statutes. This practice is known as preemption. The CDC study found that from 2004 to 2009, the number of states with provisions preempting local smoke-free restrictions in at least one of three settings - government and private worksites, and restaurants - decreased from 19 to 12.

Meanwhile, the number of states with preemptive provisions in their smoke-free laws for all settings decreased from 15 to 8.

"The tide is turning toward allowing smoke-free legislation at the local level," said Nikole Souder-Schale, southeastern regional vice president for advocacy for the American Heart Association. UF banned tobacco use in Ben Hill Griffin Stadium starting this season and on the property of health-related facilities starting Nov. 1. A university-wide ban is planned for July 1.

The proposed regulation, which is scheduled to be considered next month by UF trustees, would prohibit smoking as well as the use of smokeless tobacco and electronic devices meant to simulate smoking. It would apply to university-owned land in Alachua County and Jacksonville.

PUNTA GORDA: Punta Gorda's waterfront parks, sidewalks and bike paths help promote a healthy lifestyle. But the Charlotte County Health Department wants the city to do even more, and smokers may not like what they hear.

"What we'd like to see is a system where we have tobacco-free parks," said Scot Hoverman, a tobacco policy consultant for the Charlotte County Health Department.

BRADENTON -- Health experts will tell you that smoking can earn you a trip to the hospital.

But as of Tuesday, Manatee County's three hospitals will make sure you don't light up anywhere near their buildings.

Manatee Memorial Hospital, Blake Medical Center and Lakewood Ranch Medical Center will go tobacco-free Tuesday, following the 2007 lead of hospitals and health departments in Sarasota, DeSoto and Charlotte counties.

"It's been an ongoing process for the last two years," said Vernon DeSear, Manatee Memorial's vice president of marketing and business development. "The other (counties') hospitals did it back in 2007, and we've been catching up."

Smoking has long been banned inside hospital buildings, but it was permitted outside. Manatee Memorial had two designated smoking areas outside its complex, DeSear said.

Now, smoking and the use of any tobacco product will be prohibited everywhere on the hospital properties. ...

PANAMA CITY BEACH -- The city is moving to limit the use of portable storage units on the property of homeowners, as well as place limits on smoking at Frank Brown Park.

The City Council approved a new ordinance Thursday that would forbid portable containers for more than five days unless under emergency situations, such as a fire, hurricane or other natural disaster. They also asked city recreation director Mary Carmichael to research how other cities treat smoking at public parks, claiming the butts at Frank Brown Park were becoming unmanageable. ...

Southwest Florida hospitals are going to help employees, patients and their families quit the habit.

The NCH Healthcare System and Physicians Regional Healthcare System in Collier County are teaming up with the Lee Memorial Health System in Lee County to become tobacco-free campuses effective Nov. 19, which will be the Great American Smokeout Day in 2009.

The unified effort began as a result of a conversation in January with the chief executive officer of Lee Memorial, and the NCH leadership was brought into the discussion, said Geoffrey Moebius, chief executive officer of Physicians Regional.

"It is the right thing to do. Smoking can really have an impact on people's health," Moebius said. ...

Despite two concrete ashtrays mere feet away from the building's entrance, the evidence of study-suspending smoke breaks and post-lunch puffs litters the ground.

The trash is just one reason why universities throughout the country are going smoke-free - even tobacco-free - as the University of Florida announced Tuesday it would be by July 2010.

While FAU officials would like to clear the campus air of smoke completely, they're not there yet. But they are expecting to begin a new rule this fall that will bar smoking within 100-feet of all school buildings.
A spring vote taken by FAU students found 76 percent support segregating smokers to specific areas of campus.

Banning smoking altogether on FAU's campus earned 65 percent positive votes. ...

Football fans will have to find a new way to relieve stress when the Gators are trailing during a game.

The Ben Hill Griffin Stadium will kick off the campus-wide tobacco ban by prohibiting smoking, while all forms of tobacco will be banned at UF's Health Science Center and all Shands HealthCare buildings as of Nov. 1.

As of the first home game, where the Gators will take on Charleston Southern University on Sept. 5, the Swamp will no longer offer its current four smoking areas and will become smoke free, said Chip Howard, associate athletic director of operations at the University Athletic Association.

However, smokeless tobacco will still be allowed until July, when all of the UAA's facilities will ban all forms of tobacco in order to adhere with UF's campus-wide tobacco ban which will begin in July, Howard said. ...

CHARLOTTE COUNTY: A Southwest Florida college campus is now entirely tobacco-free. Edison State College in Charlotte County created the smoking ban for anyone who steps on campus.

The move makes the school Florida's first state-run college to put an end to smoking on school grounds.

"This is not about assessing fines or implementing disciplinary actions," said Dr. Patricia Land, Edison State College's Charlotte Campus President.

The Lee County Health Department is joining a statewide initiative to cut tobacco usage by forming a new coalition called "Tobacco Free Lee."

The first Tobacco Free Lee meeting was held Wednesday morning at the new Lee County Health Department facility on Pondella Road after the state awarded the local agency a $600,000 grant.

The Bonita Springs City Council will consider banning smoking in public parks, particularly in places where kids congregate, such as bleachers and near dugouts, as part of several updates to the city's parks ordinance.

I just returned from a week in New York City. It was so wonderful to meet friends and family, or just walk into a bar, and not be overwhelmed by cigarette smoke.

In consideration of the overwhelming evidence of the health impact of second-hand smoke, when are our city, county and state going to ban smoking indoors, period? . . .

Don't say banning smoking in bars is bad for business. All the bars in New York City and Chicago, all over California, and even in Ireland are packed.

Volusia might snuff smoking along beaches
